Appeals court hands Trump win in sanctuary city fight, says administration can deny grant money

A federal appeals court on Wednesday handed a major win to the Trump administration in its fight against “sanctuary” jurisdictions, ruling that it can deny grant money to states that refuse to cooperate with federal immigration authorities. The 2nd Circuit Court of Appeals in New York overturned a lower court ruling that stopped the administration’s 2017 move to withhold grant money from the Edward Byrne Memorial Justice Assistance Grant Program, which dispenses over $250 million a year to state and local criminal justice efforts. “Today’s decision rightfully recognizes the lawful authority of the Attorney General to ensure that Department of Justice grant recipients are not at the same time thwarting federal law enforcement priorities,” a DOJ spokesman said in a statement. “The grant conditions here require states and cities that receive DOJ grants to share information about criminals in custody. The federal government uses this information to enforce national immigration laws–policies supported by successive Democrat and Republican administrations.” “All Americans will benefit from increased public safety as this Administration is able to implement its lawful immigration and public safety policies,” the statement said. The latest decision conflicts with rulings from other appeals courts across the country concerning sanctuary policies, indicating a Supreme Court review is ultimately likely. New York City and liberal states including New York, Washington, Massachusetts and Connecticut sued the government, and the U.S. District Court for the Southern District of New York backed them — ordering the money be released and stopping the government from putting immigration-related conditions on grants. But the appeals court ruled that it “cannot agree that the federal government must be enjoined from imposing the challenged conditions on the federal grants here at issue.” “These conditions help the federal government enforce national immigration laws and policies supported by successive Democratic and Republican administrations,” the court ruled. “But more to the authorization point, they ensure that applicants satisfy particular statutory grant requirements imposed by Congress and subject to Attorney General oversight.” It also disagreed with the district court’s claim that the conditions intrude on powers reserved only to states, noting that in immigration policy the Supreme Court has found that the federal government maintains “broad” and “preeminent” power. The ruling marks a key win for the administration in its efforts to crack down on the continued use of “sanctuary” policies that limit local law enforcement cooperation with federal immigration authorities in order to shield illegal immigrants from deportation.

Kudos to the 2nd Circuit Court of Appeals for their well-considered ruling.  I understand it was a unanimous decision too.

 

Trump Admin to Send Border Patrol Special Ops on Raids in Sanctuary Cities

The Trump administration is sending officers from a special operations unit of the Border Patrol to assist in raids by Immigration Customs and Enforcement in so-called sanctuary cities. The officers from BORTAC, the Border Patrol’s version of a SWAT unit, will deploy to New York, Chicago, San Francisco, Los Angeles and various other cities whose local governments forbid law enforcement from working with federal immigration officials, the New York Times reported on Friday. Customs and Border Protection spokesman Lawrence Payne confirmed the initiative. BORTAC officers will be deployed “in order to enhance the integrity of the immigration system, protect public safety, and strengthen our national security,” Payne said. “As we have noted for years, in jurisdictions where we are not allowed to assume custody of aliens from jails, our officers are forced to make at-large arrests of criminal aliens who have been released into communities,” ICE acting director Matthew T. Albence said in a statement. “When sanctuary cities release these criminals back to the street, it increases the occurrence of preventable crimes, and more importantly, preventable victims.” BORTAC usually operates in hot, rugged areas along the U.S.-Mexico border and specializes in capturing criminals and cracking down on smuggling operations. While embedded with ICE in sanctuary cities, BORTAC officers will engage in more run-of-the-mill arrests. The news comes after Attorney General William Barr announced Monday that the Justice Department would begin a “significant escalation” against sanctuary cities. Barr said the department would move to file lawsuits against sanctuary cities and locales that actively impede federal immigration enforcement.

Sanctuary City: Illegal Alien Allegedly Raped, Impregnated Special Needs Girl

An illegal alien living in the sanctuary city of Montgomery County, Maryland has been arrested and charged with raping and impregnating a special needs child. Reynaldo Mora, a 41-year-old illegal alien from Mexico, has been charged by the Montgomery County Police Department for allegedly raping a 13-year-old non-verbal girl in her home, according to ABC7 News. Months ago, Mora was asked by the girl’s parents to babysit her and her two other siblings, according to police. This is when, police say, the illegal alien took the special needs girl into a bedroom and raped her. In mid-April, two months after the rape, the victim took an in-home pregnancy test, which came back positive. Her aunt brought her to Adventist HealthCare Shady Grove Medical Center in Rockville for further testing. Medical staff confirmed she was 11-weeks pregnant at that time. The victim would later tell investigators that Mora was the father of the unborn child. The illegal alien was arrested soon after and his lawyers immediately requested he be released on bond. In May, Montgomery County Circuit Court Judge Steven Salant allowed the illegal alien to be released, but the Immigration and Customs Enforcement (ICE) agency stepped in to take over custody of Mora. ICE confirmed that Mora has been living in the U.S. illegally and was previously working full time as a cook at a Mexican restaurant in Maryland. Now, should he be convicted, the illegal alien is facing up to 60 years in prison. Once his time is served, if convicted, he will be transferred to ICE for deportation from the U.S.

MS-13 spreads to 22 states, fed by 300,000 illegals, DACA recipients, tied to 207 murders

The vicious MS-13 gang, stifled under former President George W. Bush, exploded during the Obama era fueled by 300,000 illegals, including those given amnesty under the DACA program, and has now been linked to crimes in 22 states, according to a new report. Since 2012, 207 murders have been tied to the gang called “Mara Salvatrucha,” and there are over 500 cases nationwide of MS-13 members being charged in major crimes, according to the report from the Center for Immigration Studies. But it can sometimes be hard to deport the illegals involved because about half of the crimes detailed in the report occurred in so-called “sanctuary cities” that do not cooperate with U.S. Immigration and Customs Enforcement. President Trump has pledged to crack down on the gang and deport those in the United States illegally, and report author Jessica M. Vaughan suggested that it can’t happen soon enough. Detailing how the gang rebuilt itself under Obama’s open-border immigration policies, she said, “this resurgence represents a very serious threat to public safety in communities where MS-13 has rebuilt itself. The resurgence is directly connected to the illegal arrival and resettlement of more than 300,000 Central American youths and families that has continued unabated for six years, and to a de-prioritization of immigration enforcement in the interior of the country that occurred at the same time.” The research she supervised at the immigration think tank found that MS-13 concentrations were in areas where so-called “unaccompanied alien children” were put under Obama, including Virginia, California, Maryland and New York. They included those participating in the Deferred Action for Childhood Arrivals who Democrats in Congress are fighting for. She cited an example of a Maryland DACA recipient charged with gang activity who urged pals in El Salvador to take advantage of Obama’s policies: One MS-13 clique leader in Frederick, Md., who had received a DACA work permit and was employed as a custodian at a middle school in Frederick, Md., and who was recently incarcerated for various gang-related crimes, reportedly was told by gang leaders in El Salvador to take advantage of the lenient policies on UACs to bring in new recruits, knowing that they would be allowed to resettle in the area with few questions asked. Several of these unaccompanied minors now have been arrested and incarcerated for various crimes, including a vicious random attack on a sheriff’s deputy in 2015. Crime, torture and theft are the trademarks of the gang. “The MS-13 members identified in the cases we found were accused of very serious crimes, including 207 murders. More than 100 were accused of conspiracy/racketeering, and dozens of others were charged with drug trafficking, sex trafficking, attempted murder, sexual assaults, and extortion,” said the report. Vaughan is the center’s policy director. The report noted the difficulty in seizing and deporting some of those involved because the crimes occurred in many of the 300 sanctuary regions in the nation that don’t cooperate with ICE. “The proliferation of sanctuaries may complicate disruption of MS-13,” said the report. “Many of the hotbeds of MS-13 activity are also places where local officials have adopted sanctuary policies. These policies prevent ICE from working effectively with local law enforcement agencies. There are approximately 300 sanctuary jurisdictions in the country, and they include municipalities, counties, and states.11 About half of the MS-13 arrests in our case set (222) occurred in sanctuary jurisdictions,” said CIS.

Pretty shocking stuff!!  The threat to our communities posed by MS-13 is just one of many reasons why it is absolutely critical that we BUILD THE WALL NOW!!…and put U.S. Army National Guard troops physically ON the border with Mexico.  Then, those troops need to remain ON that border to prevent would-be crossers from setting one foot on U.S. soil.  After all, once an illegal sets one foot on U.S. soil, they entitled (and that’s the key work) to all sorts of legal and monetary freebies that we-the-actual citizens pay for.  So, those troops need to remain ON the border until that wall/fence is finally built above and below ground (to prevent tunneling)….however long it takes.  Simultaneously, we need to be deporting illegals already here by the hundreds of thousands (and yes, you read that correctly)…paying particular attention to known gang members (like these MS-13 maggots), convicted criminal aliens, and those already determined by an immigration judge to be deported..regardless of age or gender.  And that’s just for starters, folks.  To do anything less is NOT in our country’s national security, or economic, interests.

Illegal Alien Uber Driver Allegedly Raped Four Women in Sanctuary State California

A previously deported illegal alien Uber driver is accused of raping four women, three of whom were allegedly intoxicated when he assaulted them, prosecutors say. Alfonso Alarcon-Nunez, a 39-year-old illegal alien from Mexico living in San Luis Obispo, California, has been charged with raping and robbing four women while he was driving for the ride-sharing company Uber, according to the Daily Mail. San Luis Obispo County District Attorney Dan Dow told the media that Nunez’s alleged rape victims are between the ages of 19-years-old and 22-years-old, with three of them being intoxicated from alcohol when he allegedly robbed and raped them. Dow said the illegal alien would target women leaving parties while he was on duty as an Uber driver. The illegal alien would allegedly go back to the women’s homes where he would rape them and rob them, prosecutors say. Nunez is facing 10 charges for the rape, assault and robbery accusations. In 2005, Nunez was deported from New Mexico back to his native Mexico. Between 2005 and 2017, he re-entered the U.S. illegally again. The state of California is considered a “sanctuary state,” as it prevents businesses and statewide public officials and offices from cooperating with federal immigration officials to help deport criminal illegal aliens. Instead, the state acts as a safe-haven for criminal illegal aliens.

Univ CA students and Democrats file complaint, tear down ‘racist’ pictures of Kate Steinle

Students at the University of California San Diego filed a complaint and triggered an administrative probe after pictures of Kate Steinle were hung on campus. Gregory Lu said he hung up 150 posters picturing Steinle with the caption, “She had dreams too,” on Dec. 7. Four days later, he said he received an email from the Office for the Prevention of Harassment & Discrimination asking to meet with him. “Our office received an online incident report and I would like to schedule a time to speak with you about it,” an investigator wrote in the email, reported The College Fix. “Are you free this week by phone or in person.” Mr. Lu said the meeting has not taken place and he has contacted an attorney. He said the probe is an attempt to intimidate conservative students on campus, arguing that the same scrutiny would not be applied to a poster advocating a liberal stance on immigration. “We have had a bunch of left-wing posters go up all the time,” he said. “So the argument they might make is, ‘This is a political poster, we don’t want you to put it up,’ is a nonsensical argument because leftists put up posters all the time.” The UC San Diego College Democrats called the posters “racist propaganda” and “displays of hate” targeting “undocumented students and the undocumented community.” “We urge all students, staff, and other UC San Diego community members to condemn these displays of hate,” the Democrats wrote in a post on Facebook. “It is unacceptable to allow racism, bigotry, and hate to dominate the campus conversation, shifting the rhetoric of our university.” Steinle, 32, was shot and killed in 2015 while walking on a San Francisco pier by Jose Ines Garcia Zarate, a Mexican national residing illegally in the country who had been deported five times and was wanted for a sixth deportation at the time of the shooting. Her death has been a rallying cry for proponents of immigration reform, including President Trump, who question the wisdom of San Francisco’s “sanctuary city” laws barring local officials from cooperating with federal immigration authorities. Garcia Zarate, who said he accidentally fired a stolen gun that he found wrapped in a shirt under a chair on the pier, was found not guilty of murder on Nov. 30. Mr. Lu said the poster campaign was the initiative of a newly formed campus group called Right Wing West. The group posted a video on Facebook showing the pictures of Steinle being torn down. “The media and our politicians want to erase Kate’s name and story from history,” Right Wing West wrote on its Facebook page. “It’s on us to speak the name of America’s lost daughter: Kate Steinle. #EndSanctuaryCities.”

ICE Arrests 42 Criminal Aliens Released by Sanctuary New York

Immigration officers based in New York City arrested 42 criminal aliens released by sanctuary jurisdictions. Thirteen other foreign nationals were also arrested as part of a six-day targeted operation carried out by U.S. Immigration and Customs Enforcement (ICE). ICE Enforcement and Removal Operations officers began the operation on November 13 and concluded it shortly before Thanksgiving. In total, officers arrested 55 illegal aliens. Forty-two of those arrested had been in New York law enforcement custody and were released despite ICE having placed immigration detainers on the aliens, according to information obtained by Breitbart Texas from ICE officials. “Forty-two of the 55 arrested during this operation were released from New York custody with an active detainer, which poses an increased risk to the officers and the community.,” ERO New York Field Office Director Thomas Decker said in a written statement. “It is important for city residents to know that although the City of New York releases inmates with active ICE detainers back into their community, ICE will be diligent in its responsibility to find those who come to the United States to prey upon our communities and ultimately have them removed from the country.” Official said those arrested include nine women and 46 men. They illegal aliens hailed from 22 countries. Those countries include: Mexico (20); Jamaica (5), Ecuador (4), Honduras (3), Colombia (2), Dominican Republic (2), El Salvador (2), Guatemala (2), Yemen (2), Bangladesh (1), France (1), Guyana (1), Jordan (1), Nigeria (1), Poland (1), Romania (1), Slovakia (1), Spain (1), Trinidad (1), Yemen (1), Serbia (1), Egypt (1).

ICE to California: ‘No choice’ but to arrest illegal immigrants despite sanctuary state legislation

The head of the federal Immigration and Customs Enforcement (ICE) said Friday that his agency had “no choice” but to arrest illegal immigrants in California’s neighborhoods and worksites despite newly signed sanctuary city legislation in the state. Those arrested would also likely be placed in out-of-state detention centers, ICE Acting Director Thomas Homan said in a statement. Homan’s comments came a day after California Gov. Jerry Brown, a Democrat, signed state Senate bill SB54, or sanctuary state legislation. The new state law, which takes effect Jan. 1, will ban police from asking people about their immigration status or participating in federal immigration enforcement activities. Jail officials would be allowed to transfer inmates to federal immigration authorities only if they have been convicted of certain crimes. Homan cautioned the bill helped protect illegal immigrants from deportation and made the state a “magnet.” “Ultimately, SB54 helps shield removable aliens from immigration enforcement and creates another magnet for more illegal immigration, all at the expense of the safety and security of the very people it purports to protect,” Homan warned. However, Brown noted the law does not bar ICE from operating in the state. His office declined to comment further on the ICE statement Friday. “They are free to use their own considerable resources to enforce federal immigration law in California,” Brown wrote. Brown said the law does prevent the “commandeering of local officials” to do immigration work. “These are uncertain times for undocumented Californians and their families, and this bill strikes a balance that will protect public safety while bringing a measure of comfort to those families who are now living in fear every day,” Brown said.

Well, here’s a newsflash…  If they’re living here illegally, they SHOULD be “living in fear every day!”

Nearly 500 Criminal Illegal Aliens Arrested in National ‘Sanctuary City’ Sting

Nearly 500 criminal illegal aliens were arrested by U.S. Immigration and Customs Enforcement (ICE) in a four-day operation in sanctuary city jurisdictions, which shield illegal aliens from deportation. Known as Operation Safe City, ICE agents detained a total of 498 illegal aliens living in sanctuary cities who violated U.S. immigration laws; have criminal convictions or pending criminal charges; are known gang members, immigration fugitives; and those who re-entered the U.S. after already being deported, according to ICE officials. Illegal aliens who are currently shielded from deportation by the Obama-created Deferred Action for Childhood Arrivals (DACA) program were not targeted in the operation, though those individuals will become eligible for deportation as their temporary protected status expires over the next two years. Appeals court revives Texas anti-sanctuary city law

A federal appeals court revived Texas’s anti-sanctuary city law Monday, allowing key parts to take effect — including a prohibition on cities and states trying to thwart cooperation with deportation officers. Police and sheriff’s departments also are required to comply with detainer requests when the federal government asks that illegal immigrants be held for pickup, under the 3-0 ruling by a panel of the 5th U.S. Circuit Court of Appeals. The decision overturns an injunction by a district court judge — though the appeals court said the big arguments remain to be heard later. Still, the decision is a watershed moment, marking the highest court to allow states to force their localities to comply with detainer requests from U.S. Immigration and Customs Enforcement. The court said the anti-sanctuary law, known as SB4, was drawn inartfully, and the judges did uphold some of the injunction and also struck out some words, but said overall the law does not appear to tread on the federal government’s immigration powers. “Enforcing immigration law helps prevent dangerous criminals from being released into Texas communities,” said Texas Attorney General Ken Paxton, whose office defended Texas’s law.

Excellent decision by this panel of the 5th Circuit!  Outstanding!!  This is a HUGE victory for the rule of law!
