Appeals court rejects $1.8M award to Jesse Ventura in ‘American Sniper’ case

A federal appeals court on Monday threw out a $1.8 million judgment awarded to former Minnesota Gov. Jesse Ventura, who says he was defamed in the late author Chris Kyle’s bestselling book “American Sniper.” The 8th U.S. Circuit Court of Appeals rejected the jury’s 2014 award of $500,000 for defamation and $1.3 million for unjust enrichment against Kyle’s estate. Kyle, a former SEAL who was the deadliest sniper in U.S. military history with 160 confirmed kills, died in 2013. The majority of the three-judge panel reversed the unjust-enrichment award, saying it fails as a matter of law. The majority also vacated the defamation award, but sent that portion of the case back to court for a new trial. Messages left with Ventura’s publicist and attorney were not immediately returned Monday. A message left with an attorney for Kyle’s estate also did not immediately return a message seeking comment. Kyle claimed in a subchapter called “Punching Out Scruff Face,” to have decked a man, whom he later identified as Ventura, during a fallen SEAL’s wake at a California bar in 2006. He wrote that “Scruff Face” had made offensive comments about the elite force, including a remark that the SEALs “deserve to lose a few” in Iraq. Ventura, a former Underwater Demolition Teams/SEAL member and ex-pro wrestler, testified at trial that Kyle’s story was a fabrication. Ventura said he never made the comments and that the altercation never happened. He said the book ruined his reputation in the tight-knit SEAL community. The hit movie based on the book did not depict the alleged incident. Kyle, who was killed on a shooting range in 2013 by a troubled fellow veteran, gave sworn videotaped testimony before his death that his story was true. Kyle’s widow, Taya Kyle, appealed the $1.8 million judgment, asking the appeals court to throw out the verdict or at least order a new trial on First Amendment and other grounds. Ventura’s lawyers, however, argued that jury got the verdict right, and that the judge properly applied the law and correctly instructed the jury. A key issue in the appeal was whether Kyle acted with “actual malice,” a demanding legal standard laid down by the U.S. Supreme Court in the landmark Times v. Sullivan case in 1964. It means a plaintiff who’s a public figure must prove that a defendant knew that the statement in question was false or made it with reckless disregard for whether it was false. Kyle’s estate argued that the judge gave the jury faulty instructions on that point. A separate issue was the $1.3 million award for unjust enrichment. Ventura’s attorneys argued that “American Sniper” shot to the top of the best-seller lists only because Kyle’s statements about Ventura thrust him into the national spotlight. The Kyle estate argued that no other court had awarded damages for unjust enrichment for allegedly defamatory speech. The Kyle estate also said the judge improperly let the jury hear that publisher HarperCollins had an insurance policy to cover a defamation award and attorney fees. Courts are typically reluctant to permit such testimony out of concerns that it could taint a jury’s decision.

‘American Sniper’ highest grossing war film of all time

The high-flying “Mockingjay” has been shot out of the sky by the powerhouse drama “American Sniper.” The Jennifer Lawrence-led “The Hunger Games: Mockingjay – Part 1” had the distinction of being the highest-grossing film released in 2014 after earning $336.9 million at the domestic box office. Clint Eastwood’s Oscar-nominated war drama “American Sniper,” which was in limited release in four theaters on Dec. 25, opened wide Jan. 16 and spent four straight weekends at the box office top spot. As of this weekend, “American Sniper” came in 11th place — the first weekend since its release that it wasn’t in the top 10 — has earned a grand total of $337.1 million in the U.S.

Michael Moore whines: Clint Eastwood threatened to ‘kill me’ in an ‘American ISIS’ attack

Michael Moore, Hollywood’s outspoken left-leaning film maker, confirmed in a Facebook post that Clint Eastwood did in fact threaten to kill him during an awards dinner held ten years ago. And what’s more: He concluded his remarks by saying vicious verbal attacks are akin to an “American Isis,” he wrote. He posted on his Facebook page a message entitled: “The Day Clint Eastwood Said he Would ‘Kill’ Me, 10 Years Ago This Week,” and that included — in conclusion — that those who issue scathing verbal attacks are akin to Islamic State terrorists. He then went on: “A lot of people are asking me if this is true as this ‘rumor’ about Clint Eastwood confronting me in 2005 has now re-surfaced and floated around the internet in the past few days. So I thought I should say a few words … Ten years ago this past week, Clint Eastwood stood in front of the National Board of Review awards dinner and announced to me and to the crowd that he would ‘kill me if I ever came to his house with my camera for an interview. ‘I’ll kill you,’ he declared.”

Yeah..  sure he did, Michael…ya big baby.  You really can’t make this stuff up.  Let’s stop and think about this..  Clint Eastwood is a pretty soft spoken gentleman.  Assuming this happened 10 years ago (he’s currently 84), Clint would have been 74.  And, we’re talking about Clint Eastwood; aka Dirty Harry.  It’s hard to fathom “the Enforcer” making ANY threats to anyone.  He doesn’t have to.  He’s Clint Eastwood.  Ya know?  And, the former mayor of Carmel, CA is well liked and respected (regardless of political ideology) throughout the HollyWEIRD community.  Michael is just making up outrageous bs to get back in the limelight, and is probably jealous that Clint’s movie is breaking all sorts of records.  Michael is just a little, jealous, liberal, child…whining like the calorically-challenged sissy la la that he is.  Loser..

NBC’s Mohyeldin Suggests Real American Sniper a ‘Racist’ Who Went on ‘Killing Sprees’

Ayman Mohyeldin has suggested that Chris Kyle, the real “American Sniper,” was a “racist” whose military missions were nothing less than “killing sprees.” With opinions like that, you might imagine Mohyeldin to be some unhinged bloviator from the bowels of the anti-American far left. Or, an NBC foreign correspondent [who formerly worked for Al Jazeera] who regularly reports on events in the Middle East. Which is exactly what he is. Ayman vented his bile on today’s Morning Joe.

Ayman is more than you’re typical liberal, anti-war journalist working for NBC and MSNBC…who used to work for that pro-Islamic, anti-America, pro-terrorist propaganda organ called Al Jazeera.  No.  Ayman was born in Cairo to an Egyptian father and a Palestinian mother.  Yeah..   No wonder liberals are so against profiling.  Anyway, you get the picture.  Good on Joe for calling Ayman on HIS ridiculous, and hate-filled accusations…and making him look like the fool he is.

Opinion: It’s the patriotism, stupid. What liberal critics don’t get about “American Sniper”

There’s no denying it. Clint Eastwood’s “American Sniper” has struck a chord with the American people, and did so by tapping into the deepest civic values we have as Americans – duty, honor, fidelity, courage, love for country…and a love for others. However, no war movie can live on the big screen without a spew of liberal backlash, and this film is no different. Criticism has come quickly from Michael Moore, Seth Rogen, former Vermont Gov. Howard Dean and other Hollywood leftists.

Michael Moore invokes Jesus in ‘Sniper’ rant, Todd Starnes fires back

Clint Eastwood’s “American Sniper” had another jaw-dropping weekend, reaching an impressive $200 million at the domestic box office. Despite the film’s colossal success, liberals like former DNC chairman Howard Dean and director Michael Moore just won’t let “American Sniper” go. Over the weekend, Moore invoked Jesus in a slew of incendiary tweets aimed at dishonoring American soldiers and the Iraq war.

Michael Moore is an disgusting, self-righteous, limousine-liberal hypocrite.  That calorically-challenged blow-hard will show up unshaven in his goofy baseball cap, and claim to be a regular union-joe…in a limousine, or his personal Lear jet, of couse.  Michael lives in a multi-million dollar mansion on a Michigan lake, paid for from the millions he’s made making movies that tear America apart.  In other words, he uses capitalism (and makes millions through it) to attack capitalism.  If that’s not brazen hypocrisy, I don’t know what is.  And, when he’s not making movies, he’s doing and saying any vulgar thing he can to get on tv.  This is just the latest example of that.  It’s probably driving him bonkers that a movie like “American Sniper” is doing so well at the box office.  Good on Todd Starnes for calling him on it.

‘American Sniper’ To Out-Gross All 18 Anti-War On Terror Films Combined

Over the course of about 5 years between 2004 – 2009, Hollywood produced no fewer than 18 anti-War On Terror box office bombs that defamed our country, our troops, and the righteous cause of the war against Islamic extremism. Every single one of those films bombed. The flop rate was 100%. Even Leftists stayed away in droves.

But, boy did they turn out to see “American Sniper.”  This doesn’t surprise me one bit..  But, it must be driving the HollyWEIRD liberal elite bananas!

‘American Sniper’: Same Leftists Defaming Chris Kyle as ‘Killer’ Wanted Every Iraqi Dead

Because they are freaked out over what the critical and box office success ($105 million opening weekend) of “American Sniper” might mean for our culture and on Oscar night, the very same Hollywood Left (and Left in general) who poured their wicked hearts and souls into a campaign that would have resulted in the murder of millions of innocent Iraqis, are now falsely accusing American hero Chris Kyle of murdering Iraqis.
